PRIVACY AND CONFIDENTIALITY POLICY OF THE «MORAN» ONLINE STORE
(hereinafter – «Privacy and Confidentiality Policy»)
This Privacy and Confidentiality Policy has been developed in accordance with the requirements of the Law of Ukraine "On Personal Data Protection" and other regulatory acts of Ukrainian legislation governing legal relations related to the collection, processing, and storage of personal data, as well as the right of citizens to non-interference in personal life and the right to self-expression. Also – in accordance with the requirements of European legislation, the General Data Protection Regulation (GDPR; Regulation (EU) 2016/679).
Terms
1.1. The following terms are used in this Privacy and Confidentiality Policy:
1.1.1. «MORAN» – FOP Ukrei O.O., Tax ID: 3277212613, which is the owner of the «MORAN» Online Store and sells goods or services.
1.1.2. «Administration of the «MORAN» Online Store Site (hereinafter – Site Administration)» – authorized persons managing the site, acting on behalf of the «MORAN» Online Store, who organize the processing and collection of personal data, and determine the purposes of personal data processing, the composition of personal data subject to processing and collection, actions or operations performed with personal data.
1.1.3. ««MORAN» Online Store» – an online platform on the Internet, located at: https://moran.com.ua/, where the User can purchase goods or services from «MORAN».
1.1.4. «Personal Data» – any information relating directly or indirectly to a specific individual (subject of personal data), including the Site User.
1.1.5. «Personal Data Processing» – any action (operation) or set of actions (operations) performed with or without the use of automation tools with personal data, including: collection, recording, systematization, accumulation, storage, clarification (update, change), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction of the User's personal data.
1.1.6. «Confidentiality of Personal Data» – a mandatory requirement not to allow the distribution of personal data of the subject (User) without the personal consent of the individual or the presence of another legal basis, which is adhered to by the Site Administration or other persons who have gained access to personal data.
1.1.7. «User of the «MORAN» Online Store Site or «User» – an individual who can be identified directly or indirectly, in particular by an identifier such as name, identification number, location data, online identifier, or by one or more factors characteristic of physical or physiological, genetic, mental, economic, cultural, or social identity of that individual (Art. 4(1) GDPR). A User is also a person who purchases goods or services from «MORAN» or simply visits the «MORAN» Online Store.
1.1.8. «Cookie» – a small piece of data sent by a web server and stored on the user's computer, which the web client or web browser forwards to the web server in an HTTP request each time it attempts to open a page of the corresponding site.
1.1.9. «IP Address» – a unique network address of a node in a computer network built on the IP protocol.
SUBJECT OF THE PRIVACY AND CONFIDENTIALITY POLICY
2.1. By using the site or purchasing a product or service offered in the «MORAN» Online Store, the User confirms that they consent to «MORAN» and the Site Administration and persons authorized by them to collect and process personal data.
2.2. The User gives their consent to the Site Administration and «MORAN» to process the received information, including collection, systematization, accumulation, storage, clarification (update, correction), use, distribution, depersonalization, blocking, destruction of personal data specified in the questionnaire, for the purpose of measures aimed at forming a database of participants, compiling statistical reports, conducting marketing research, as well as implementing interaction with the User, including via telecommunications networks, including sending SMS messages and emails, until such consent is withdrawn.
2.3. The User confirms their consent that the Site Administration and «MORAN» have the right to interact with the User by making direct contacts using various means of communication, including but not limited to: mail, email, the Internet, etc.
2.4. Personal data permitted for processing and collection within this Privacy and Confidentiality Policy include, but are not limited to, the following information:
2.4.1. Client Data (Individual-User): – first and/or last name; – email; – phone; – company name; – organization number and address; – delivery address; – link to the individual on social networks; – IP address.
2.4.2. Transaction Data: – payment information from an individual (User) and other information about services or goods ordered in the «MORAN» Online Store.
2.4.3. Financial Data: – information about bank account and credit or debit card, account and invoice information, payment methods.
2.4.4. Contact Data: – information or records created as a result of contact with «MORAN» or the Site Administration. For example, this may be a phone conversation, online contact, contact via email, physical mail, or messengers such as Viber, Telegram, WhatsApp, and others.
2.4.5. Technical Data: – IP address, date and time of request, request content, access status/HTTP status code, website sending the request, browser, operating system and its interface, language and browser software version.
2.5. In the process of any communication between the User and «MORAN», the Site Administration, the latter have the right, for the purpose of improving service quality, to record a conversation with the User or store any data about communication between the User and «MORAN», the Site Administration.
COOKIE POLICY
3.1. «MORAN» and the Site Administration collect information about the User's visit to the «MORAN» Online Store for the purpose of obtaining visit statistics and their effectiveness, forming a personal approach and adapting to the interests of each User. The Site Administration and «MORAN» do this using various technologies, one of which is cookies. This is data that a website can send to a browser, and it will be saved on the computer for subsequent identification by the website.
3.2. Cookies are used to evaluate website effectiveness (for example, to measure the number of visitors and the duration of their stay on the «MORAN» Online Store site), identify the most interesting and visited topics and pages, as well as to ensure convenient navigation and use of the above site, without collecting any personal information. Cookies can also be used to form a personal approach based on the existing experience of interaction between the User or any other person with the «MORAN» Online Store and its advantages. Over time, this information allows improving the experience.
3.3. Cookies are text files sent by the «MORAN» Online Store to the User's device, which allows improving the «MORAN» Online Store site. Cookies are unique to the User's account or browser.
3.4. The User will be notified about the use of cookies during the first visit to the «MORAN» Online Store site. If the User is against collecting information using cookies, they can configure the choice through the Cookie Settings Center at any time.
3.5. Browsers provide the User with the ability to manage cookies according to requirements. The User can manage and/or delete, restrict, or block cookies from the site at any time by modifying the browser configuration. If the User does not want to use cookies on the «MORAN» Online Store site, they must first disable cookies in their browser.
3.6. Through browser settings, the User can choose which cookies to accept and which not. Such settings directly depend on which browser the User uses: – cookie settings in Chrome; – cookie settings in Firefox; – cookie settings in Internet Explorer; – cookie settings in Safari. If the User decides to block certain functional cookies, some «MORAN» services may be unavailable to the User. In addition to settings that may be available on the «MORAN» Online Store site, the User can refuse to use individual cookies.
COLLECTION AND USE OF PERSONAL DATA
4.1. «MORAN» and the Site Administration collect personal data in the following cases: – when the User visits the «MORAN» Online Store site; – when the User fills out contact forms on the «MORAN» Online Store site; – when the User follows the newsletter placed on the «MORAN» Online Store site; – when the User contacts «MORAN» or the Site Administration by phone, including through messengers, email, in the website chat, or through social networks; – «MORAN» and the Site Administration may obtain personal data of an individual when the User clicks a button on social networks: "like", "subscribe" or in another way of interaction with the official pages of «MORAN» on Instagram and other platforms.
PURPOSE OF COLLECTION AND PROCESSING OF PERSONAL DATA
5.1. The «MORAN» Online Store and the Site Administration use the User's personal information for the following purposes:
5.1.1. Contractual Purpose: – to enter into a contract, contractual information about an individual, namely: first and last name, phone number, email, and delivery address; – to enter into a contract, execute, manage, and ensure compliance with services or sell products, including any related contract, additional documents such as appendices, amendments, etc.; – to share personal data with a partner, provide services or sell goods to an individual; – to manage payment or commissions and fees; – to inform the User about changes/additions to all services or goods provided or sold through the «MORAN» Online Store, as well as the Privacy and Confidentiality Policy, and cookies; – when «MORAN» and the Site Administration sends the User ordered goods, and these goods are sent by own forces or a logistics (postal) company; – to notify the approximate time of service provision or product delivery to the User.
5.1.2. Legal Purpose: – for statistics, analysis, and market research; – to analyze and improve «MORAN» products and services; – to send goods to the User by mail (logistics companies); – to notify the User's personal data to authorized state bodies in accordance with legislation; – to support «MORAN» business processes; – to track, verify, and record communication between the User and «MORAN»; – from time to time send the User marketing information, useful information, new offers; – to notify the User about the results of claim consideration (if any); – to notify about the «MORAN» contact person who will contact the User; – for the purpose of offering the Client to join various types of promotions, programs, loyalty systems, etc., organized by «MORAN»; – for the purpose of ensuring the conduct of «MORAN» various types of promotions, programs, loyalty systems, etc., including registration of the User in its own database of persons participating in such promotions, programs, loyalty systems, etc.; – for the purpose of informing Users about the procedure for conducting promotions, programs, loyalty systems, etc., organized by «MORAN», as well as informing about changes to policies, rules, regulations, instructions, etc.; – to comply with other legal obligations.
USER RIGHTS
6.1. The User, regarding their own personal data provided for collection, accumulation, processing, storage, and use by «MORAN» and the Site Administration on the basis of the Law of Ukraine "On Personal Data Protection" and the General Data Protection Regulation (GDPR; Regulation (EU) 2016/679), has the following rights:
- to know about the sources of collection, location of their personal data, the purpose of their processing, location;
- to receive information about the conditions for providing access to personal data;
- to access their personal data;
- to receive information regarding whether their personal data is being processed;
- to submit a reasoned request to «MORAN» with an objection to the processing of their personal data;
- to submit a reasoned request regarding the change or destruction of their personal data if such data is processed illegally or is inaccurate;
- to protect their personal data from illegal processing and accidental loss, destruction, damage in connection with intentional concealment, non-provision or untimely provision, as well as protection from providing information that is inaccurate or defames the honor, dignity, and business reputation of an individual;
- to file complaints regarding the processing of their personal data with competent authorities or a court;
- to apply legal remedies in case of violation of legislation on personal data protection;
- to make reservations regarding the limitation of the right to process their personal data when giving consent;
- to withdraw consent to the processing of personal data;
- to know the mechanism of automatic processing of personal data;
- the right to make changes to incomplete or inaccurate personal data;
- the right to delete personal data if the person has successfully exercised the right to object to data processing;
- the right to refuse consent to the processing of personal data at any time;
- the right to object to the use or processing of personal data by «MORAN» and the Site Administration if the person believes that this affects their rights and freedom.
6.2. To exercise the rights described above, it is necessary to contact «MORAN» at the email address: hennamoran@gmail.com. If «MORAN» receives a request from the User to exercise any of the above rights, «MORAN» may ask the User to confirm their identity before acting on the request. This is necessary to ensure the protection and security of personal data.
TRANSFER AND DISCLOSURE OF PERSONAL DATA OF AN INDIVIDUAL
7.1. «MORAN» and the Site Administration do not transfer or disclose any personal data about the User without their consent, except for the purposes mentioned in this Privacy and Confidentiality Policy, or if required by law.
7.2. «MORAN» and the Site Administration may use the services of third parties to provide and sell goods to the User. All processors acting on behalf of «MORAN» process the User's data only in accordance with «MORAN» instructions and strictly comply with this Privacy and Confidentiality Policy, and cookies, the legislation of Ukraine and the European Union.
MEASURES TO PROTECT USER PERSONAL DATA
8.1. «MORAN» and the Site Administration take measures to ensure the protection and security of the User's personal data at all stages of processing, including through organizational and technical measures.
8.2. «MORAN» and the Site Administration take all necessary measures to prevent accidental loss, use, or unauthorized access, modification, or disclosure of the User's personal data.
8.3. «MORAN» and the Site Administration have implemented a process for eliminating personal data security breaches or incidents and will inform the User and any relevant regulator about a suspected breach or incident if «MORAN» or the Site Administration is required to do so by law.
8.4. If «MORAN» or the Site Administration transfers the User's personal data, «MORAN» will require third parties to take measures to protect personal data. «MORAN» and the Site Administration do not grant any rights to third parties to use personal data for their own purposes. A third party may use the User's personal data for a specific purpose and in accordance with «MORAN» instructions.
ADDITIONAL INFORMATION ABOUT USER PERSONAL DATA
9.1. «MORAN» and the Site Administration are not obligated to provide the User's personal data to third parties.
9.2. «MORAN» and the Site Administration store personal data only as long as necessary.
9.3. Processing is lawful only if the data subject (User) has given consent to the processing of their personal data for one or more specific purposes. Processing of a child's personal data is lawful if they have reached 16 years of age. If the child has not yet reached 16 years of age, such processing is lawful only if consent is given by parents or permitted by a person who has parental responsibility for the child.
9.4. The «MORAN» Online Store may contain links to other websites. However, if the User uses these links, the User should be aware that «MORAN» and the Site Administration do not control these websites. Thus, «MORAN» and the Site Administration are not responsible for the protection and confidentiality of any information that the User provides when visiting such sites, and such sites are not governed by this Privacy and Confidentiality Policy. The User should be careful and familiarize themselves with the policy applied to the relevant website.
ADDITIONAL TERMS
10.1. «MORAN» has the right to make changes to the Privacy and Confidentiality Policy without the User's consent, notifying about this 30 (thirty) calendar days before the changes take effect.
10.2. The new Privacy and Confidentiality Policy comes into force from the moment of its placement on the «MORAN» Online Store site, unless otherwise provided by the new edition of the Privacy and Confidentiality Policy.
10.3. In case of changes that significantly change the User's rights to confidentiality, «MORAN» or the Site Administration will send an additional notification by email to the User. If the User does not agree with the changes to this Privacy and Confidentiality Policy, it is necessary to contact «MORAN» at the email address: hennamoran@gmail.com.
10.4. In case of disagreement with any changes made to the Privacy and Confidentiality Policy, the User must stop using the «MORAN» Online Store, and also has the right to demand that the Site Administration and «MORAN» delete their User personal data. If «MORAN» or the Site Administration has not received a refusal from the User from the new edition of the Privacy and Confidentiality Policy, this means that the User has agreed to the new edition of the Privacy and Confidentiality Policy.
10.5. The User may file a complaint regarding the violation by «MORAN» or the Site Administration of legislation governing personal data protection to a court or to the Commissioner of the Verkhovna Rada of Ukraine for Human Rights in the field of personal data protection.
